Rosconn Strategic Land achieved High Court success after Parish Council challenge fails to overturn permission for housing on an allocated site in Great Dalby, Melton

Rosconn Strategic Land are delighted to announce that the sale of its site at Great Dalby in Melton Borough can now proceed after last month’s judgement in the High Court confirmed that the Planning Committee’s determination of the planning application was sound. Rosconn were represented by Thea Osmund-Smith of No. 5 Chambers, who provided invaluable support to the Borough Council in defending its decision at a virtual Court Hearing, after the original hearing in April had been postponed due to the Covid pandemic.

The site extends to 4.4 acres with outline planning permission originally secured in July 2019 for 35 dwellings. The scheme includes the provision of 40% much needed affordable homes as well as financial contributions towards local infrastructure improvements. Due to the site’s partial location within the village conservation area and the wider setting of a listed church, Rosconn decided to include matters relating to access and layout to further de-risk the planning permission for the prospective purchaser.

Marketing of the site will now proceed in earnest for what will be a high quality development in this attractive rural Leicestershire village.
